The Marshal of the Sejm, Włodzimierz Czarzasty, announced that he would file a report with the prosecutor regarding the threats directed at Maciej Ber, a judge of the Constitutional Tribunal. He simultaneously emphasized that the lower house elected eight new judges of the Tribunal in recent months and demands that the president and other institutions enable them to begin working.
Proceedings regarding threats
According to the Marshal, on the X portal, a post by Rafał Ziemkiewicz appeared on October 31 of this year, in which the following words were spoken: "You will hang." Czarzasty stated that the Polish state cannot leave such statements without reaction, therefore, as the Marshal, he will file a report with the prosecutor against the aforementioned publicist.
Election of judges and the role of the president
The Marshal reminded that the Sejm elected eight judges of the Constitutional Tribunal in recent months. He emphasized that legally elected judges are obliged to start adjudicating, and the duty of the state and its institutions is to provide them with conditions for performing their duties. Czarzasty criticized the conduct of President Karol Nawrocki, who, according to the Marshal, violated the separation of powers and the independence of the Tribunal. He pointed out that the president entered the TK building "boots and all" and remained there until 5 a.m.
Constitutional complaint and support from former presidents
Włodzimierz Czarzasty announced that he would use the right to a constitutional complaint based on Article 191 of the Constitution of the Republic of Poland. He added that his predecessors had not used this privilege, but he intends to use it. The Marshal named four former presidents of the Constitutional Tribunal – professors Zoll, Safjan, Stępień, and Zdziennicki – who, according to him, supported actions aimed at rectifying the situation in the TK.
Reasons for refusing to participate in consultations
The leader of the Left explained that his party did not participate in the political consultations with the president, which took place on October 31. Czarzasty argued that the president cannot play the role of an arbitrator in a conflict in which he is a party and creator. He declared that the only arbitrator can be the law, therefore neither he nor the Left met with the president on this matter.
