Police officers from the Road Traffic Department in Otwock stopped a 41-year-old woman driving a Volvo in Duchnow. The test conducted revealed that her blood alcohol concentration at the time of the stop was 2.1 promille. Expedited proceedings were applied in the case, allowing for a final verdict to be issued just 24 hours after the incident.

Expedited proceedings and criminal liability

The vehicle was stopped during routine duty when the driver's specific driving style aroused the suspicion of the officers. An immediate breathalyzer test confirmed the act of driving a vehicle while intoxicated. Given the high result (2.1 promille), investigators from Józefów and Wiązowna decided to immediately refer the case to the court in expedited proceedings.

Thanks to this procedure, the accused appeared before the judiciary in a very short time after the stop, which resulted in a final judgment after one day. Such a rapid response by the judiciary is intended to ensure that perpetrators of serious traffic violations face the consequences of their actions in the shortest possible time.

Court ruling

The court imposed severe penalties on the 41-year-old woman, taking into account both the penal and economic aspects of the crime. The woman was obligated to pay a fine of 3,000 zlotys. Furthermore, the court ruled that she must pay 5,000 zlotys to the Fund for Victims and Postpenitentiary Assistance.

As part of the supplementary or alternative penalty to imprisonment (depending on the nature of the ruling, although the facts mention a ban), a three-year ban on driving all mechanical vehicles was imposed. However, the most significant financial consequence was the decision regarding the forfeiture of property. The court ruled on the forfeiture of the Volvo to the State Treasury.

Vehicle confiscation

The vehicle's forfeiture was ruled in accordance with regulations applicable when a driver exceeds the level of 1.5 promille of alcohol in their body. In this case, the alcohol concentration (2.1 promille) significantly exceeded the statutory threshold, providing grounds for the application of this penalty. The transfer of the car to the State Treasury means the permanent loss of vehicle ownership by the perpetrator, regardless of her later financial situation or ability to pay the fine.

The article illustrates the effectiveness of cooperation between the police and the judiciary in cases of gross violations of traffic regulations. The application of expedited proceedings and the ruling on property forfeiture constitute a strong deterrent for drivers who decide to drive a vehicle under the influence of alcohol at a concentration posing a fatal danger to other road users.
