On October 31, 2026, Prime Minister Donald Tusk issued a statement addressing the events in front of the Constitutional Tribunal building. The head of the government called these incidents "outrageous events" and pointed to the presence of politicians and activists associated with Law and Justice (Prawo i Sprawiedliwość) and Konfederacja on the scene, mentioning Mariusz Bąkiewicz and Rafał Braun among them. In Tusk's assessment, the police intervention protecting the judges was a response to the harassment of people performing their duties.

Context of the dispute over judges

The Prime Minister recalled that after weeks of waiting, during which attempts were made to repair the Tribunal, the Sejm elected new judges. According to the government's account, the president did not receive their oaths, and President Święczkowski (listed in the statement as a blocker of proceedings) prevented them from starting work. When the judges decided to begin performing their functions without waiting for a change in the tribunal president, they were attacked. The police reacted to signs of aggression, defending the institution and its members.

The issue of compromise

Donald Tusk emphasized that a democratic state must be capable of enforcing justice and cannot yield to lawlessness. In his statement, he used the metaphor of a thief who, after being caught, accuses the victim of violence while they are trying to take back the stolen goods. In the prime minister's opinion, compromise is impossible in fundamental matters such as protecting the rule of law.

Tusk accused his political opponents of acting to destroy the rule of law. He noted that these groups find support among pro-Russian forces worldwide, and that in recent days their activity was supported by an army of Russian bots on the internet. The Prime Minister also pointed out that they received public compliments from a Kremlin ideologue, which in his opinion confirms their affiliations.

Government announcements

At the end of the speech, Donald Tusk declared that the government, as the executive branch, will ensure the safety of the Constitutional Tribunal and appropriate conditions for its work. The head of the government emphasized that Poland is a strong and democratic country where law must prevail over violence, and the Tribunal will begin to operate in accordance with the constitution.
